2010 GREATER OUTDOORS PROJECT
TERMS AND CONDITIONS
NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO APPLY FOR THE REDWOOD CREEK WINES GREATER OUTDOORS PROJECT GRANT.
1. ELIGIBILITY: APPLICANTS MUST BE LEGAL RESIDENTS OF ONE OF THE FIFTY (50) UNITED STATES OR THE DISTRICT OF COLUMBIA AND AT LEAST 21 YEARS OLD AT THE TIME OF APPLICATION, unless otherwise voided herein. An applicant must only enter on behalf of and as representative of his/her organization that is currently registered as a 501(c) (3) Nonprofit organization, that is environmentally focused and is domiciled and resides within the United States. 501 (c) (3) Environmentally Focused Nonprofit organizations cannot be targeted at or benefit individuals 21 years of age or younger. Any 501 (c) (3) Environmentally Focused Nonprofit organizations that are targeted at or benefit individuals 21 years of age or younger will not be eligible. Determination of whether an organization qualifies as an environmentally focused Nonprofit shall be under the supervision of Hunter Public Relations ("Administrator”) whose decisions shall be final in all matters relating to the Greater Outdoors Project. Employees of the Administrator, Redwood Creek (“Sponsor”) or their alcoholic beverage distributors and retailers, affiliates, subsidiaries, advertising and promotion fulfillment and/or the immediate family members of each are not eligible to participate. No Applicant may apply if his/her organization holds an alcohol license or permit. The Greater Outdoors Project is subject to all applicable federal, state and local laws and regulations. Void for organizations that reside in UT, TN, Puerto Rico, U. S. Virgin Islands and other U. S. territories and possessions, military installations and commonwealths where prohibited by law.
2. SPONSOR: The Sponsor is Redwood Creek, d/b/a Frei Bros. Vineyards, Modesto, CA. 95353.
3. TO APPLY: The Grant Application Process begins at 12:00:01 AM Eastern Time (“ET”) on December 1, 2009 and ends at 11:59:59 PM Eastern Time (“ET”) on February 28, 2010. To apply, visit www.RedwoodCreek.com, complete the required information on the Official Application Form displayed, and submit the Online Application Form as directed. Individuals who submit an Application will be deemed the “Applicant” applying for a Grant on behalf of their Nonprofit organization. Applicants will be required to provide the following: A) Submit your complete name, address, telephone number, date of birth, E-mail address, and the name, address and telephone number of the Nonprofit organization on whose behalf you are applying; B) Submit a Project Plan of no more than 750 words which will preserve, protect and/or provide access to the Great American Outdoors. The Project Plan must benefit the American public who are at least 21 years of age or older; C) Submit a budget for the Project Plan not to exceed $50,000; and D) Submit up to two (2) digital photos that showcase the Nonprofit organization’s purpose or mission. (A, B, C and D stated herein are collectively, “Application”). The digital photographs must be in JPEG or PDF format and cannot exceed 300 dpi (dots per inch) or 1 MB (megabyte). Limit one Application per Nonprofit organization. In the event the same Application is submitted more than once, the first Application received will be eligible and all duplicate Applications will be disqualified. All Applications become the property of the Sponsor. Applications will not be acknowledged or returned. Sponsor is not responsible for lost, late, incomplete, misaddressed, or otherwise misdirected Applications that are processed late or incorrectly or are lost due to computer or electronic malfunction or other error. By submitting an Application, including photographs, Applicants have irrevocably granted Sponsor the royalty-free right throughout the world to use, re-use, copy, publish, republish in whole or in part, edit, add to, modify, and rearrange the Application in whatever media, including without limitation edit, rearrange, and/or copy the Application for use in the advertising and promotion of Sponsor’s products without further permission, consideration or payment to the Applicant, except where prohibited by law. IF YOU WOULD LIKE YOUR E-MAIL ADDRESS USED FOR FUTURE MARKETING PURPOSES, PLEASE MAKE SURE THE APPROPRIATE BOX ON THE APPLICATION FORM IS CHECKED. ALL ONLINE APPLICATIONS MUST BE RECEIVED BY 11:59:59 PM ET, ON FEBRUARY 28, 2010.
4. JUDGING CRITERIA: All Applications will be judged by Sponsor, whose decisions in all matters relating to the Greater Outdoors Project will be final and binding. Applications will be reviewed and nine (9) Finalist Applications will be selected based on the following criteria: Persuasiveness of the Application (0-20 points); Does the Application help preserve, protect or provide access to the Great American Outdoors? (0-30 points); Feasibility of Proposed Budget (0-20 points); and Overall impression of the Application (0-30 points). The nine (9) Finalist Applicants will be notified by telephone, email, or mail on or about March 15, 2010. Each Finalist Applicant will receive an Affidavit of Eligibility and Liability and a Publicity Release. Each Finalist Applicant will be required to complete, sign and return the Affidavit of Eligibility and Liability and Publicity Release within ten (10) business days of delivery. Non-compliance within this time period may result in disqualification and the selection of an alternate Finalist Application. Any Finalist Applicant notification returned to Sponsor as undeliverable may result in disqualification and the selection of an alternate Finalist Applicant. In the event that more than one Application is received with the same or nearly identical submission, only the first such Application received will be eligible. In the event of a tie, the Applicant among the tied Applications with the highest score in the Overall Impression of the Application Category will be the Finalist. If a tie still remains, the Applicant among the still-tied Applications with the highest score in the Does the Application help preserve, protect or provide access to the great American outdoors Category will be the Finalist. Sponsor reserves the right not to select any Finalists or award any Grant, if in their sole and absolute discretion they do not receive a sufficient number of qualified Applications. If your Application is selected as the winner, you will be required to execute a Grant Award Agreement, which will detail the terms and conditions of the Grant.
5. ONLINE VOTING: The nine (9) Finalist Applications will be posted at www.RedwoodCreek.com between 12:01 AM EDT on April 1, 2010 and 11:59:59 PM EDT on August 31, 2010. Individuals who log on to www.RedwoodCreek.com between 12:01 AM EDT on April 1, 2010 and 11:59:59 PM EDT on August 31, 2010 will be asked to select one (1) Finalist Application (hereinafter, “Online Voting Period”). Limit one (1) online vote per person/email address per day. The Finalist Application who receives the highest number of votes will be deemed The Greater Outdoors Project Grand Grant Recipient. The remaining eight (8) will be deemed the Finalist Grant Recipients. In the event of a tie among the number of highest number votes, the Sponsor will determine the Grant Recipient based on the judging criteria stated in Paragraph #4. 6. GRANTS: There will be ONE GRAND (1) GRANT ($50,000) AND EIGHT (8) FINALIST GRANTS ($10,000 each): One (1) Grand Grant winner organization will receive a $50,000 check made payable to the Nonprofit organization listed on the winning Grand Grant Finalist Application. Total value of the winner Grand Grant: $50,000. The eight (8) Finalist Grant Recipients will each receive a $10,000 check made payable one each to the Nonprofit organizations listed on the eight (8) Finalist Grant Application(s). Total value of the runner-up Grants: $10,000 each. The estimated total value of all prizes is $130,000. No substitution, assignment, or transfer of any Grant permitted. IIfIf selected as a Greater Outdoors Project Grant Recipient, Applicant must be available to participate in any and all scheduled public relations activities on dates designated by Sponsor. In the event Applicant is not available on dates designated by Sponsor, the Applicant may be disqualified and the Greater Outdoors Project Grant may be awarded to an alternate Applicant.
7. CLAIMING PRIZE/RELEASE: Eligibility, age and grant claim by Applicants on behalf of the Grand Grant or Finalist Grant Nonprofit organization recipient is subject to verification. The Grant Nonprofit organization will be notified by overnight mail delivery on or about August 15, 2010. Sponsor is not responsible for fraudulent calls or E-mails made to entrants not by Sponsor. Potential Grant Nonprofit organization must sign before a notary and return an Affidavit of Eligibility/Prize Acceptance/Liability and (where legally permissible) a Publicity Release Form within ten (10) business days of receipt. Non-compliance may result in disqualification and the Grant may be awarded to an alternate Nonprofit organization based on the judging criteria outlined in Paragraph #4. Should a Nonprofit organization be awarded a Grant, the organization will not receive any grant money until a Grant Agreement Letter, a Release of Liability and Publicity Consent supplied by the Sponsor has been signed by the Nonprofit organization, and the 501(c)(3) Nonprofit documentation has been received by the Sponsor. The Grant Agreement letter will bind the Nonprofit organization to the Terms and Conditions as set forth in the Grant Agreement letter. The Publicity Consent form will authorize the Sponsor to use the likeness, name, image and biography of the Nonprofit organization and the representative who submitted the Application, as well as the Application for purposes of advertising and trade.
8. INTERNET: If for any reason the Greater Outdoors Project is not capable of running as planned due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Greater Outdoors Project, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Greater Outdoors Project. The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Applications. The Sponsor is not responsible for any problems or technical malfunctions of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Contest or downloading any materials in the Greater Outdoors Project. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GREATER OUTDOORS PROJECT IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity or eligibility of any entry based on an E-mail address, the entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at time of Application. "Authorized Account Holder" is defined as the natural person, 21 years of age or older, who is assigned to an E-mail address by an Internet access provider, online service provider or other organization (e.g., business, education institution, etc.) that is responsible for assigning E-mail addresses for the domain associated with the submitted e-mail address. Use of automated devices is not valid for Application.
9. GENERAL: In regard to the Grant, no substitution, assignment, or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. Total retail value of one (1) winner Grand Grant to be awarded: $50,000. Total retail value of eight (8) Finalist Grants to be awarded: $10,000 each. By entering the Greater Outdoors Project and/or accepting a Grant, winning Nonprofit organization: (1) agrees to be bound by these Terms and Conditions; (2) agrees to release Sponsor, its alcoholic beverage distributors and retailers; affiliates, subsidiaries; advertising and promotion fulfillment and/or judging agencies and all related entities from all liability, claims, action, or proceedings relating to participation in the Greater Outdoors Project and from injuries or damages relating to the acceptance or use of the Grant; and (3) consent to the use of the non-profit organization and representative’s name, voice, pictures, likeness, and entry for editorial, publicity, advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law.
10. NAME OF GRANT RECIPIENT/TERMS AND CONDITIONS: To receive the names of the winning organizations, (available after September 10, 2010), or a copy of the Terms and Conditions, send a self-addressed, stamped #10 envelope to: “Greater Outdoors Project", c/o Hunter Public Relations, 41 Madison Avenue, 5th FL, New York, NY 10010. Please specify "Terms and Conditions" or "Name of Grant Recipient" on the outer mailing envelope. Your request must be sent so that it is received by October 31, 2010.
